Terms and Conditions

1. Acceptance of Terms

By accessing and using the services provided by Mapleshades (the Photographer), including booking, consultation, and delivery of any photography or videography service, you agree to be bound by these Terms and Conditions. These terms govern the contractual relationship between the Photographer and the Client.

2. Booking, Payments, and Cancellations

2.1 Deposit and Confirmation

A non refundable retainer or deposit is required to secure services for the agreed date and time.
The booking is confirmed only when the retainer is received and a signed Service Agreement or Contract is completed by both parties.

2.2 Payment Schedule

The remaining balance is due according to the Service Agreement, typically 7 days before the shoot date.
Late payment may result in cancellation and forfeiture of the retainer.

2.3 Cancellations and Postponements

Cancellation by Client: All retainers are non refundable. Additional payments may be subject to a cancellation fee based on the Service Agreement.
Postponement: Rescheduling will be attempted. A new retainer or rescheduling fee may apply if the date changes less than 30 days before the event.
Cancellation by Photographer: In case of unforeseen circumstances, a partial refund will be provided. The Photographer will attempt to recommend an alternative professional.

3. Service Execution and Client Cooperation

3.1 Coverage and Schedule

The Client agrees to assist in ensuring all required individuals are available for photos and that the timeline is followed.
The Photographer is not responsible for missed images caused by the Client, guests, or other vendors.
No food shots or photos of people eating will be taken.

3.2 Safety and Environment

The Client must provide a safe and peaceful working environment.
The Photographer may cease services immediately without refund if exposed to aggression or unsafe conditions.

3.3 Food and Refreshments

For services exceeding 6 hours, the Client must provide a hot meal or refreshments for the Photographer and accompanying staff.

4. Image and Copyright Ownership

4.1 Copyright

All photographs, films, and related intellectual property remain the exclusive copyright of Mapleshades.
No image may be published, sold, or submitted to competitions without written permission.

4.2 Client Usage Rights

The Client receives a non exclusive, non transferable, perpetual personal usage license. You may:

Print photographs for personal use.
Share digital files on personal social media platforms with credit to Mapleshades and without altering the images.
Use images for personal keepsakes such as frames and albums.

Commercial use requires a separate written licensing agreement and fee.

4.3 Photographer Usage Rights

The Photographer may use the images for portfolio, website, social media, advertising, display, or professional contests.
The Client must notify the Photographer before signing the contract if privacy is required. A non disclosure agreement may involve an additional fee.

5. Image Processing, Delivery, and Storage

5.1 Artistic Control

The Photographer retains full artistic and technical discretion over image selection and editing.
Raw or unedited files will not be provided.

5.2 Delivery Timeline

Delivery timelines are specified in the Service Agreement. This is usually 6 to 8 weeks for shoots and longer for full wedding packages.

5.3 Post Delivery Storage

The Photographer will store final delivered files for a period specified in the Service Agreement, typically six months. The Client is strongly advised to create multiple backups after receiving the files.

6. Products, Albums, and Prints

Album designs, prints, and products are fulfilled after written approval.
The Photographer is not responsible for color issues from third party printing labs used by the Client.

7. Limitation of Liability

If services cannot be performed due to technical failure, injury, or circumstances beyond control, liability is limited to a partial refund.
The Photographer is not liable for indirect or consequential damages.

8. Governing Law and Disputes

These terms are governed by the laws of India under the jurisdiction of Delhi courts.
Disputes will first be addressed through good faith negotiation, then mediation, before litigation.
